Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Mpega mobile application, any related web experience, and associated booking, payment, ticketing, and support features (together, the “Service”). By creating an account, downloading the app, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
This document is a practical template aligned with the Service’s features and Google Play disclosure needs. It is not legal advice. Have qualified counsel review it for Botswana law, your company structure, operator contracts, and store policies before relying on it as your only compliance document.
1. Who we are and what the Service does
Mpega is a digital platform that helps passengers search bus routes and schedules, select seats, pay for travel, receive tickets (including QR tickets), manage reservations, and board with participating bus operators (“Operators”). The Service may also provide tools for Operators and their authorized staff (for example agents, conductors, operations, or finance users).
Afriport provides the technology platform. Unless we expressly say otherwise, the carriage of passengers is performed by the relevant Operator under that Operator’s transport rules. We are not the carrier for trips sold by third-party Operators on the platform.
2. Eligibility and accounts
- You must be able to form a binding contract under the laws of Botswana (or your place of residence, if stricter rules apply).
- You must provide accurate registration details (such as name, email, and/or mobile number) and keep them up to date.
- You are responsible for safeguarding your sign-in credentials and for activity under your account. Notify us promptly of unauthorized use.
- We may suspend or deactivate accounts that are inaccurate, abusive, fraudulent, inactive, or in breach of these Terms.
- Phone numbers linked to deleted accounts may be restricted from reuse for security and fraud prevention.
3. Roles on the platform
Depending on how you are invited or registered, you may use the Service as a passenger/commuter or as an Operator staff user (for example sales agent, conductor, liner administrator, or finance). Staff accounts are granted by Afriport or the Operator and may be revoked. Staff must use the Service only for authorized operational purposes and must not misuse passenger data, tickets, payments, or validation tools.
4. Bookings, seats, and tickets
- A booking becomes a confirmed paid reservation only when payment (or an accepted payment method such as wallet credit or authorized counter payment) succeeds according to the flow shown in the app.
- Unpaid seat holds are temporary and may expire or be released back to sale if payment is not completed in time. An expired hold is not a cancellation and does not create a refund entitlement.
- Ticket details (route, departure, seats, passengers, and status) appear in the app. You must present a valid ticket (digital or as otherwise accepted by the Operator) when boarding.
- Booking cut-offs may apply before departure. The Service may refuse new bookings, changes, or cancellations within a configured time window before departure.
- Schedules, fares, stops, and vehicle assignments are provided by Operators and may change due to operational needs, traffic, weather, regulation, or safety.
5. Payments
- Fares and fees are generally shown in Botswana Pula (BWP) unless otherwise indicated.
- Available payment methods may include card payments (processed by Stripe), mobile money such as Orange Money where enabled, in-app wallet balance, and pay-at-counter options for authorized agents. Availability depends on Operator and platform configuration.
- Card data is processed by Stripe; we do not store your full card number on our servers.
- You authorize us and our payment partners to charge the selected method for the amounts displayed at checkout, including applicable taxes or fees shown before you confirm.
- Failed, reversed, or disputed payments may result in ticket cancellation or voiding without carriage entitlement until resolved.
6. Wallet credit
Where enabled, cancellation credit or other promotional value may be stored in an in-app wallet. Wallet balances:
- are not cash bank deposits and generally have no cash-out right except where required by law or expressly offered by us;
- may be limited in how many wallet refunds you can receive in a calendar year;
- may expire after a configured lifespan (for example a number of months after credit is issued);
- may only be used for eligible bookings on the Service; and
- may be adjusted or removed for error, fraud, abuse, or breach of these Terms.
7. Cancellations, reschedules, refunds, and no-shows
- Cancellation. You may request cancellation through My Reservation where the booking status and cut-off rules allow it. Tickets already boarded or used generally cannot be cancelled.
- Cut-offs. Changes and cancellations may be blocked within a configured period before departure (platform default is commonly around two hours, but the live setting in the Service controls).
- Wallet refund path. Where eligible, a cancellation may return value to your wallet subject to yearly limits and cut-offs shown in the app.
- Card or other refund path. Where a money refund is available, you may need to request it in the app. Processing may require Operator or platform review and is completed through the original payment channel where practicable. Timing depends on banks and payment partners.
- Reschedule. Where offered, you may move a booking to another eligible departure subject to seat availability, fare difference, and cut-off / advance-window rules.
- No-shows. If you miss the departure without a permitted cancellation or reschedule, the fare is generally forfeited and seats are not guaranteed for a later trip.
- Operator rules. An Operator may apply additional carriage, baggage, or refund rules. Where those rules are stricter and lawfully disclosed, they may apply to that trip.
- Service disruptions. If a trip is cancelled or materially changed by the Operator, remedies (rebooking, credit, or refund) will follow the options we and/or the Operator make available for that event.
Always review the confirmation dialog and on-screen policy text before you cancel or reschedule; those screens reflect the rules in force for that booking.
8. Passenger conduct and prohibited use
You agree not to:
- use the Service for unlawful, fraudulent, or abusive purposes;
- interfere with ticket validation, QR codes, seat inventory, payments, or other users’ accounts;
- scrape, reverse engineer, or attack the Service except to the extent such restriction is prohibited by law;
- upload harmful content or misuse camera/scanning features;
- harass staff or other users through support or in-app channels; or
- resell tickets in breach of Operator or platform rules.
9. Operator and third-party services
The Service may integrate maps, messaging, cloud hosting, analytics, authentication, and payments (including Google Firebase and Stripe). Their terms and privacy policies also apply to the portions they provide. Optional features (for example city mobility experiences branded separately) may have additional notices when you open them.
10. Intellectual property
Afriport and its licensors own the Service software, branding (including Mpega and related Afriport marks), and content we provide. You receive a limited, personal, non-exclusive, non-transferable licence to use the Service as offered. You may not copy, modify, or distribute our software or marks without written permission.
11. Privacy
Our collection and use of personal information is described in our Privacy Policy. Account deletion instructions are available in the app and at https://kaekapakae.com/Delete-Account.html.
12. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we do not warrant that the Service will be uninterrupted, error-free, or that schedules and Operator information will always be complete or current. Travel involves inherent risk; Operators remain responsible for vehicle operation, safety, and on-the-ground customer service for their trips.
13. Limitation of liability
To the fullest extent permitted by applicable law:
- Afriport is not liable for delays, missed connections, baggage issues, Operator staff conduct, accidents, or carriage failures attributable to Operators or circumstances beyond our reasonable control;
- Afriport’s total liability arising out of or relating to the Service for any claim is limited to the greater of (a) the amount you paid through the Service for the booking giving rise to the claim in the three months before the claim, or (b) BWP 500; and
- we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, even if advised of the possibility.
Nothing in these Terms excludes liability that cannot be excluded under Botswana law (including for fraud or death/personal injury caused by negligence where such exclusion is unlawful).
14. Indemnity
You agree to indemnify and hold harmless Afriport and its officers, employees, and partners from claims arising out of your misuse of the Service, your breach of these Terms, or your violation of law or third-party rights, except to the extent caused by our wilful misconduct.
15. Suspension and termination
You may stop using the Service at any time and may delete your account where that feature is available. We may suspend or terminate access for breach, risk, legal compliance, or prolonged inactivity. Provisions that by nature should survive (including payments owed, IP, disclaimers, liability limits, and governing law) continue after termination.
16. Changes to the Service and to these Terms
We may update features, fares displayed on behalf of Operators, cut-offs, and these Terms. We will post the updated Terms on this page and revise the effective date. Material changes may also be highlighted in the app or by email. Continued use after the effective date constitutes acceptance of the updated Terms, except where mandatory law requires a different process.
17. Governing law and disputes
These Terms are governed by the laws of Botswana. Courts of Botswana have exclusive jurisdiction, without prejudice to any non-waivable consumer protections that apply to you. Before filing a claim, please contact support@mpega.app so we can try to resolve the issue.
